1. About us
Yorkshire Mobility Direct is a trading name of Yorkshire Mobility Hire Limited, company number 17493044.
Our correspondence address is:
Suite 26, The Plex
15 Margaret Street
Wakefield
WF1 2DQ
Email: hello@yorkshiremobilitydirect.co.uk
Telephone: 0113 460 1236
We are an online and mobile mobility equipment business. Our correspondence address is not a public showroom or a place to return equipment without arranging this with us first.
These terms apply when you use our website or purchase equipment from us as a consumer. A consumer is an individual buying mainly for personal use rather than for their trade or business.
Business purchases and equipment hire are subject to separate terms agreed before the contract is made. Servicing and repairs are subject to the quotation and booking terms provided for that work.
2. Product information and suitability
We aim to provide accurate descriptions, specifications, photographs and prices. Colours may appear slightly different depending on your screen.
The product description forms part of your purchase agreement. Changes to a listing after you order do not change the agreed specification of your purchase.
Preloved equipment will be identified as such. Its description will explain its condition, relevant wear, included accessories and any known faults.
Please check important specifications before ordering, including dimensions, weight limits, transport weight, folding arrangements and suitability for your intended use. Published range figures may depend on conditions such as terrain, temperature, user weight and battery condition.
If you are unsure whether a product meets your needs, contact us before ordering. Where you tell us about a particular purpose and rely on our advice, your legal rights concerning suitability continue to apply.
Our product advice does not replace an individual assessment by an appropriate healthcare professional where one is needed.
3. Placing an order
Please check your order, contact details and delivery address before completing payment.
Placing an order is an offer to buy the products selected. An automated acknowledgement confirms that we have received your order. We accept your order when we expressly confirm acceptance or dispatch the goods, whichever happens first.
If we cannot accept your order—for example, because an item is unavailable, payment cannot be authorised or there is a pricing error—we will explain this and refund any payment taken without undue delay.
We will not substitute a different product or increase an agreed price without your consent.
Nothing in this section removes your cancellation rights.
4. Prices and payment
Prices are shown in pounds sterling. Any applicable VAT and delivery charges will be made clear before you place your order.
Where a product is advertised at a price available only to customers eligible for VAT relief, this will be clearly identified. Eligibility depends on the customer and the product; a disability or medical condition does not automatically make every purchase eligible.
Any required declaration and the amount payable will be explained before you complete the purchase.
Payment must be made using an authorised payment method. You must have permission to use the payment details provided.
If we discover a pricing error before accepting your order, we will contact you to confirm whether you wish to proceed at the correct price or cancel for a full refund.
Promotions may have additional conditions, such as an expiry date or a restriction to selected products. These will be explained with the offer.
5. Delivery and supplier direct fulfilment
Delivery availability, charges and expected timescales are explained on the product page, at checkout or before we accept your order.
New equipment includes free standard delivery to UK mainland addresses where stated. Delivery to Northern Ireland, islands and other locations must be confirmed separately.
Some products are dispatched directly by a manufacturer or supplier on our behalf. Your purchase contract remains with Yorkshire Mobility Hire Limited, trading as Yorkshire Mobility Direct. We remain responsible for fulfilling your order and helping with delivery problems, returns and faulty goods.
Please do not assume that delivery includes unpacking, assembly, demonstration, removal of packaging or delivery upstairs. The service included with your order will be explained before purchase.
Tell us about any access restrictions or assistance you require before ordering so we can confirm suitable arrangements.
Unless we agree a different timescale, we will deliver without undue delay and within 30 days of entering into the contract.
If delivery is delayed, we will keep you informed. Your legal rights may allow you to set a reasonable further delivery deadline or cancel, including where an agreed delivery date was essential.
Goods remain at our risk until you, or someone you nominate, takes physical possession. A different rule can apply if you independently appoint a carrier that we did not offer.
Please contact us promptly if equipment arrives damaged, incomplete or incorrect. Photographs can help us resolve the issue, but a delay in reporting does not automatically remove your statutory rights.
6. Changing your mind
For most purchases made online or by telephone, you can cancel without giving a reason from the time you place your order until 14 days after the day you receive the goods.
Where goods from one order arrive separately, the cancellation period normally ends 14 days after the day you receive the last item.
To cancel, email hello@yorkshiremobilitydirect.co.uk or contact us using the details above. Include your name and enough information to identify the order. A clear statement that you wish to cancel is sufficient.
You must send the goods back within 14 days after telling us you are cancelling, unless we have agreed to collect them.
Contact us for the correct return destination, particularly where equipment was dispatched directly by a supplier. This helps us arrange the return; it does not mean you need our permission to exercise your cancellation rights.
You may inspect goods as you reasonably would in a shop. We may make a lawful deduction for any loss in value caused by handling beyond what is necessary to establish their nature, characteristics and functioning.
Original packaging is helpful for safe transport, but it is not a condition of your statutory cancellation rights.
7. Return costs and refunds
For a change-of-mind return, you pay the direct return cost only where we informed you of this before purchase.
For goods that cannot normally be returned by post, we must also provide the return cost or a reasonable estimate before purchase. Where we have not provided the required information, we bear that cost.
When you cancel the whole order, we refund the purchase price and the cost of our least expensive standard delivery option. Any extra amount paid for an upgraded delivery service is not refundable as part of a change-of-mind cancellation.
We will refund you without undue delay and within the applicable 14-day period. Unless we have offered to collect the goods, we may withhold the refund until we receive them back or you provide evidence of return, whichever happens first.
Refunds are made using the original payment method unless you expressly agree otherwise, without a refund fee.
We do not impose a flat restocking fee on statutory consumer cancellations.
8. Exceptions to cancellation rights
Some goods may be excluded from change-of-mind cancellation rights, including:
-
Goods genuinely made to your specifications or clearly personalised.
-
Sealed goods that are unsuitable for return for health protection or hygiene reasons, if unsealed after delivery.
We will explain any applicable exception before purchase. We do not treat all mobility or bathroom equipment as automatically excluded.
An item being ordered from a supplier, discounted or preloved does not by itself remove cancellation rights.
These exceptions do not remove your rights if goods are faulty, misdescribed or otherwise fail to meet legal requirements.
9. Faulty goods, warranties and aftercare
Goods must be as described, of satisfactory quality and fit for purpose. For preloved goods, relevant factors include their age, price, description and disclosed condition.
If there is a problem, contact us with your order number, product details and a description of the fault. Stop using equipment if you believe it may be unsafe.
You normally have a 30-day right to reject goods that do not meet the relevant legal requirements. After that, repair or replacement will generally be the first remedy, with a price reduction or final rejection available where the legal conditions are met.
Where a statutory remedy is due, we bear the necessary reasonable costs, including appropriate return or collection costs.
Any manufacturer’s or additional commercial warranty is described separately. Warranty periods and cover may vary between products and components.
A warranty is additional to your statutory rights. We will not require you to deal exclusively with a manufacturer when you are exercising rights against us as the seller.
Further information is available in our Returns and refunds policy and Warranty and aftercare information.
10. Safe use of equipment
Please read the manufacturer’s instructions and follow the stated limits, charging guidance, maintenance requirements and operating instructions.
Use compatible chargers, batteries and accessories. If you are unsure, ask us before using them.
Damage caused by misuse, accidental damage or unsuitable modifications may fall outside warranty cover. This does not remove your rights in relation to an inherent fault or another failure for which we are legally responsible.
11. Accounts and website use
Please provide accurate information and keep your account login details secure. Contact us if you believe someone has accessed your account without permission.
You must not use our website to commit fraud, send malicious software, harass others, obtain personal information unlawfully or interfere with its security or operation.
We may restrict access where reasonably necessary to address misuse or a security risk. This will not remove your rights relating to an existing order, refund or complaint.
12. Website content and reviews
Website text, photographs, graphics, logos and other materials belong to us or their respective owners. You may browse, share links and retain information needed for your own purchase. Other commercial use requires permission from the relevant rights holder.
Reviews must reflect genuine experience and must not contain unlawful, misleading or abusive material. Any incentive received for a review should be disclosed.
By submitting a review for publication, you allow us to display it and use reasonable extracts to promote our business. We will not change its meaning. We may remove content that breaches these requirements.
13. Shopify, third-party services and privacy
Our online store is hosted by Shopify. Your purchase contract is with Yorkshire Mobility Hire Limited, trading as Yorkshire Mobility Direct, rather than Shopify.
Our website may link to independent providers, including insurance providers. Where you choose to enter into a separate agreement directly with another provider, that provider’s terms apply to its service.
This does not affect our responsibility for goods sold by us, including goods delivered by a supplier on our behalf.
Our Privacy Policy explains how personal information is used. Information about Shopify’s handling of personal data is available in Shopify’s Privacy Policy.
14. Our responsibility to you
We are responsible for foreseeable loss or damage caused by our breach of contract or our failure to use reasonable care and skill. Loss is foreseeable where it is an obvious consequence or where you and we knew it might occur when the contract was made.
We do not exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
We do not exclude your statutory rights concerning the quality, description, suitability or delivery of goods.
These terms are intended for consumer purchases. If you intend to buy mainly for business purposes, please contact us so that appropriate terms can be agreed before purchase.
15. Complaints
If you are unhappy with a product or our service, please contact hello@yorkshiremobilitydirect.co.uk or call 0113 460 1236.
Please explain what has happened and the outcome you are seeking. We will investigate and respond as promptly as reasonably possible.
Using our complaints process does not prevent you from seeking independent advice or exercising your legal rights.
16. Changes to these terms
We may update these terms for future orders. The version in force when your contract is made applies to that purchase unless we agree a change with you.
We will not retrospectively remove rights or impose additional charges on an existing order simply by updating this page.
If a provision is found to be unenforceable, the remaining provisions continue to apply where they can do so fairly. A delay in enforcing a right does not mean that right has been waived.
17. Governing law
These terms are governed by the law of England and Wales.
If you live in Scotland or Northern Ireland, you also retain the protection of any mandatory consumer laws that apply where you live. You may bring proceedings in the courts of the UK country in which you live.
Nothing in these terms restricts rights or remedies available to you under applicable consumer law.
